- Head of the department having administrative control over the department.
- Implementation of the policy decision of the government communicated from time to time.
- Monitoring the implementation of various legislations enforced by the Department.
Carrying out all duties and responsibilities entrusted to him as the head of the Department.
- Represent the department before different forum.
- To approve plan, issue and grant of licence, renew the licence, transfer, issue of duplicate licence, amend the licence and accept the stability certificates.
- To grant exemption under Section 65 (2) of the Factories Act, 1948.
- He is also an Inspector under Section 8 (i) of the Factories Act, 1948.
- Enforce the provisions envisaged under the Child Labour (P&R) Act, 1986 since he has been notified under Section 17 of the said Act.
In addition to the power conferred under Section 8 (i) of the Factories Act, 1948 the Additional Chief Inspector of Factories has got the additional power as follows:-
- To assist the Chief Inspector of Factories in his day to day administration.
- To oversee the work of subordinate offices/officers.
- Enforce the provisions envisaged under the Child Labour (P & R) Act 1986.
- Assist the head office in the activities related to occupational health and medical surveillance in the registered factories.
- Identification of notifiable diseases in registered factories.
- Certify child/young person employed in the factories.
- Carryout medical examination in the factories involving dangerous process or operation.
- Enforce the provisions envisaged under the Child Labour (P & R) Act 1986 since they have been notified under Section 17 of the said Act.
- Examination and certifying young persons employed in factories.
- Examine persons engaged in factories in such dangerous occupation or process as may be prescribed.
- Exercise such medical supervision as may be prescribed for any factory or class or description of factories where
a) Cases of illness have occurred where it is reasonable to believe are due to the nature of the manufacturing process carried on, or other conditions of work prevailing there in.
b) By reason of any change in the manufacturing process carried on or in the substance used there on or by reason of the adaptation of any new manufacturing process or of any new substance for use in a manufacturing process, there is a likelihood of injury to the health of workers employed in that manufacturing process.
c) Young persons are, or about to be employed in any work which is likely to cause injury to their health.
- Assist the head of the department in day to day administrative matter.
- Supervise the work of establishment Section.
- Monitoring the clearance section.
- Any other work given by the Chief Inspector of Factories.
- Supervise the works of respective section
- Scrutiny of files submitted by subordinate staff.
- Deal the compliance cases directly and submit to the next higher authority.
- Discharge the duties of the respective section as envisaged under the office Procedure.
- To supervise the work of entire account section and to take care of the following works-
- Preparation of annual budget and expenditure statement.
- Reconciliation of departmental revenue and expenditure
- Allotment of budget of various office of the department under different heads.
- To discharge duties as superintendent of legal section as per office procedure
- Scrutiny of the files viz. prosecution, compliance accident etc. submitted by concerned cash work.
- Assist the Chief Inspector of Factories in quick disposal of legal files.
- Updating the statistics pertaining to prosecution compliance and accident.
- If required to attend court, Law Department/Prosecution Department.
- Update and monitor the amendment to the Rules and regulations enforced by the Department and correspondence with DGFASLI.
- Overall in-charge to look after the workings of the Statistic section.
- Collection of data from Annual/ Half yearly returns submitted by the factory management, then compilation and preparation of Returns for submission to the Labour Bureau, Govt. of India.
An inspector may within the local limits for which he is appointed:-
- Enter with such assistants, being person in the service of the Government or any local or other public authority (or with an expert) as he thinks fit, any place which is used,or which he has reason to believe is used as a factory.
- Make examination of premises, plant, machinery articles or substances.
- Inquire in to any accident or dangerous occurrences.
- Require the production of any prescribed registers.
- Seize or take copies of any registers, record or other document as he considers necessary in the enforcement of the legislation.
- Take measurement and photographs, record statement and to seize any article or any substance found in any premises which appears to him as having caused or likely to cause danger to the health or safety of other workers.
- Issue prohibitory orders in case of any imminent danger at the factory site.
- Prosecute conduct or defend before a court any complaint or other proceeding arising under the Act or in discharge of his duties as an Inspector.
- Enforce the provisions envisaged under the Child Labour (P & R) Act, 1986 since they have been notified under Section 17 of the said Act.
- In addition to the power of Inspector of Factories as mentioned above the Senior Inspector of Factories has the power to :-
- Oversee the work of subordinate offices/officers.
