To be appointed under the Assam Factories (Safety) Officers Rules,1980. A person shall not be eligible for appointment as Safety Officer unless he-
(i) Possesses a degree of a recognized University or its equivalent in any branch of Engineering or Technology with two years experience in a position of supervision of management in a factory in either the production or the maintenance or the Safety Department, or a degree of a recognized University in Physics and Chemistry with five years experience in a position of supervision or management in a factory in either the production or the maintenance of the Safety Department.
(ii) Possesses a degree or diploma or certificate in industrial safety recognized by the Staate Government;
(iii) Has thorough knowledge of Assamese;
(iv) Has qualified at a viva voce test conducted by a Board constituted by the Labour Department, Government of Assam, for the purpose;
(v) Can speak Hindi; and
(vi) Is not less than 23 years of age;
Provided that the Chief Inspector of Factories, Assam, may exempt from the requirement of clause (b) of this rule for any person.
(i) Who has not less thn five years experience in department of the Central or a State Government which deals with the administration of the Factories Act, 1948 (63 of 1946) or the Indian Dock Labourers Act, 1934 (19 of 1934) or
(ii) Who has not less thn five years experience on a full time basis in training or education consultancy or research in the field of accident prevention in any factory or in any institution :
Providing further that the Chief Inspector of Factories, Assam, may exempt from all or any of the prescribed qualifications any person who has been working as a Safety Officer in any factory for a period of not less than five years on the date of commencement of these rules and who, in his opinion, possesses the requisite practical experience to serve as a Safety Officer.
(i) Possess a degree of a University, recognized by the State Government inthis behalf,
(ii) Has obtained a Degree or Diploma in Social Science from any institution recognized by tha State Government in this behalf; and
(iii) Has adequate knowledge of Assamese and Hindi and of the language spoken by the majority of the workers in the factory to which he is to be attached;
Provided that in the case of person who is acting as a Welfare Officer at the commencement of these rules the State Government may, subject to such conditions as it may specify, relax all or any of the aforesaid qualifications;
Provided further that while preference shall be given to those having a Diploma, the State Government may grant exemption in suitable case until such time as better facilities in the matter of training in Social Science are made available throughout the country.
To be appointed under rule 61P(1) should qualifications included in Schedules to the Indian Medical Degrees Act of 1916 or in the Schedules to the Indian Medical Council Act,1956 and possess a Certificate of Training in Industrial Health of Minimum three months duration recognized by the State Government:
Provided that-
(i) A person possessing a Diploma in Industrial Health or equivalent shall not be required to possess the certificate of training as aforesaid;
(ii) The Chief Inspector may, subject to such conditions as he may specify, grant exemption from the requirement of this sub-rule, if in his opinion a suitable person possessing the necessary qualification is not available for appointment;
(iii) In case of a person who has been working as a Factory Medical Officer for a period of not less than 3 years on the date of commencement of this rule, the Chief Inspector may subject to the condition that said person shall obtain the aforesaid certificate of training with in a period of three years, relax the qualification.
The syllabus of the course leading the above certificate, and the organizations conducting the course shall be approved by the Diractorate General of Factory Advice Service and Labour Institute or the State Government in accordance with the guidelines issued by the theDiractorate General of Factory Advice Service and Labour Institute.
Generation of posts for physically handicapped person in factories and appointment thereon is governed according to provisions as envisaged in The Assam Physically Handicapped Persons (Employment in Factories) Act,1986.
Conditions:
No Physically Handicapped Person shallbe employed under section 3 of the Act, unless-
(i) He is an adult;
(ii) His name is registered at any employment exchange in the State; and
(iii) A certificate of fitness granted under Section 5 of the Act is in the custody of the manager of the factory.
