An entrepreneur, intending to set-up a factory involving any manufacturing process as defined under section 2(k) of the Factories Act, 1948; other than manufacturing process defined under section 2 (cb) of the said Act, is required to obtain previous permission of the State Government or the Chief Inspector of Factories in writing for the site on which the factory is to be situated and for construction of factory building, installation of machinery, prime movers and/ or connection of electrical power for the purpose of the said Act.

(A)An entrepreneur shall apply in prescribed form along with documents mentioned in item 7 (1) below to the Chief Inspector of Factories, Assam, Guwahati – 5
(B)Submitted documents and drawings shall be examined and processed.
(C)If permission for the site is granted then one set of approved drawings shall be issued for construction of buildings, installation of machineries, etc. as per plans and specification.
(D)If permission is rejected, fresh/corrected documents shall be sought for resubmission.
Prescribed form No. 1 in triplicate and signed by the applicant.
(i) All the columns must be filled in ink in block letters or neatly typed and no column should be left blank,
(ii) Address should be clear and complete with pin code.
(iii)Particulars of the Plant & Machinery (to be installed) are to be mentioned in detail.
An occupier / Licensee should have the following eligibility.
(A)In case of proprietorship: Proprietor.
(B)In case of partnership: Any one of the partners.
(C)In case of Public Ltd Co. : Any one of the Directors
(D)In Case of Pvt. Ltd Co.: Anyone of the shareholders.
(E)In Case of Govt. / Local Fund: Chief Administrative Head of the Unit.
(NB)
(1)If any person named against any of the categories is minor, the fact should be clearly stated.
(2)In case of category (C) or (D) above if a managing agent has been appointed as occupier under the Indian Companies Act 1956 (1 of 1956) information only of that person should be furnished.

(i) drawn to scale showing the site of the factory and immediate surroundings including adjacent buildings and other structures, roads drains etc.
(ii) drawn to scale showing the plan, elevation and necessary cross- section of the various buildings, including all relevant details relating to natural lighting, ventilation and means of escape in case of fire. The plan shall also clearly indicate the position of the plant and machinery, aisles, electrical panels, switches, motors with rated H.P. etc and passage ways.
(e)NOC from local authorities in respect of non- agricultural land, forest, wet land, hills, sanctuaries etc (SDG – 15, Assam vision 2020)
(f)Govt.’s order granting permission for site (in case of Hazardous factory only)
(g)Clearance certificate from the controller of explosives wherever applicable.
(h)Certified true copy of executed deed of ownership/ lease/ allotment of land/ building/ flat etc.
